Florida Abortion Restrictions
Knowing what abortion restrictions are in Florida will help you better understand the care you can receive.
Florida law requires a person to have two appointments at least 24 hours apart to obtain an abortion. The first visit will include lab work, an ultrasound, education, and options information, and a meeting with a doctor to discuss the abortion procedure. The second visit will include the abortion procedure.
24 Hour Mandatory Waiting Period
6 Week Ban (effective 5/1/2024)
After 2 years of litigation, the Florida Supreme Court voted to uphold the 15-week abortion ban passed in 2022 thus starting the 30-day countdown for the 6 week abortion ban . The only exceptions to this ban are for survivors who got pregnant as the result of a sexual assault, incest, and human trafficking and are cooperating with law enforcement. We consider this a total abortion ban.
In May of 2025, Florida’s fifth district court of appeals eliminated the option for judicial bypass for minors, save for very narrow situations. Judicial bypass is a waiver process that requires minors to petition a judge to allow them to get an abortion without parental consent- this process is no longer available to Florida youth. This decision by Florida courts effectively changes this law to serve as an abortion ban for young people without safe parents to involve. This gives parents unprecedented legal control over the bodily autonomy and personal decision-making of young folks.
Removing the judicial bypass option for teens creates additional barriers for those who need to access abortion care.
