We cannot always count on the police, Immigration & Customs Enforcement and Customs & Border Patrol respecting our rights, but we need to be informed and equipped with resources so that we have a plan should you or someone you love come into contact with these authorities.

You have constitutional rights:

  • DO NOT OPEN THE DOOR if an immigration agent is knocking on the door.

  • DO NOT ANSWER ANY QUESTIONS from an immigration agent if they try to talk to you.

  • You have the right to remain silent.

  • DO NOT SIGN ANYTHING without first speaking to a lawyer. You have the right to speak with a lawyer.

  • If you are outside of your home, ask the agent if you are free to leave and if they say yes, leave calmly. I am running a few minutes late; my previous meeting is running over.

  • GIVE THE OFFICER THIS CARD. If you are inside your home, show the card in the window or pass it under the door.

REAL ID

Let’s be clear- laws like REAL ID aim to restrict and further police the freedom of movement between states. While we’re still not sure what enforcement of REAL ID will look like, we want our communities to have these resources in their back pocket should any barriers arise during travel.

  • What is REAL ID?

    • REAL ID is a federal law that sets specific requirements for state-issued driver’s licenses and prohibits federal agencies from accepting driver’s licenses that do not comply with those requirements. The federal government says it will start enforcing REAL ID beginning May 7, 2025.

  • What are other forms of identification accepted by TSA besides REAL ID?

  • Valid passports

  • Passport cards

  • Trusted traveler cards

  • Greencards

  • Border Crossing Cards

  • Veteran Health Identification Cards

  • Photo IDs from federally recognized Tribal Nations

  • How can I get a REAL ID?

    • Visit your state’s driver’s licensing agency website to find out exactly what documentation is required to get a REAL ID. At a minimum, you will have to provide documents showing:

  1. Your full legal name;

  2. Date of birth;

  3. Social security number;

  4. Two proofs of primary address and

  5. That you have citizenship or are a permanent resident (you can prove this with a U.S. passport, U.S. birth certificate, Certificate of Naturalization, Certificate of Citizenship, or a Permanent Resident card).
